Scope of Work
The Non-Disclosure Agreement is established between Transnet SOC Ltd and a Company (the "Receiving Party") to govern the exchange and protection of "Confidential Information" in the context of Transnet's Request for Information (RFI), Request for Proposal (RFP), or Request for Quotation (RFQ). This agreement ensures that any information shared for the purpose of a "Bid or Bid Document" is treated as secret and confidential.
The agreement applies to parties involved in discussions or negotiations related to a Bid. The Receiving Party must ensure its Agents (directors, officers, employees, etc.) are aware of and comply with the confidentiality duties. Compliance with South Africa's general privacy protection laws (Section 14 of the Bill of Rights) and appropriate technical/organisational measures for data processing are warranted.
